NEW YORK CORRUPTION ATTORNEY

Corruption Attorney in New York

Enterprise corruption is a challenging and complex charge to fight, and it requires a qualified defense attorney to beat it. A corruption conviction can be devastating, requiring up to twenty-five years in prison, the loss of property and wealth, and a lifetime of dealing with all of the consequences of a felony conviction.

The New York penal code specifies that enterprise corruption is not simply a single act, but a series of repeated criminal acts as a part of a business, commercial, professional, industrial, social, political or governmental activity. Members of that enterprise who commit a pattern of crimes on behalf of the enterprise can be tried for enterprise corruption if they knowingly profit from those criminal acts or maintain interest in the enterprise, knowing of its pattern of crimes.

What is a “Pattern of Criminal Acts”?

A pattern of criminal acts that can be defined as enterprise corruption must include three offenses. If two of those are felony offenses, one is a felony and all three happened within five years, or all three occur within three years, it is considered enterprise corruption and can be prosecuted as a class B felony.

An enterprise corruption conviction can destroy all of the effort that the defendant put into an organization. The state reserves the right to confiscate all proceeds that the convicted has gained from the criminal, and a grand jury can force the accused to forfeit these proceeds even before a conviction is handed down.

Build a Solid Defense Against Corruption Charges

Accusations of enterprise corruption can do serious damage to the credibility of the accused and jeopardize the company or organization the accused represents. The right defense lawyer can help fight off corruption accusations while the prosecution builds its case. However, with the right assistance, it is possible to defeat the accusations and restore the good name of both the individual and the organization.
